Thug who drank 10 cans of cider before attacking partner is jailed at Leeds Crown Court

A drunken thug attacked his partner then threatened to burn her family after months of domestic abuse, a court heard.

Barry Hutton, who punched, kicked and throttled her at times during their troubled year-long relationship, admitted charges of assault and coercive control at Leeds Crown Court.

Prosecuting, Austin Eric Newman told the court that Hutton's partner had moved in with him earlier this year but said their relationship "deteriorated" with the defendant repeatedly assaulting her during arguments, even inserting his fingers down her throat during one dispute.

On the evening of August 14, Hutton had been drinking heavily at his home on Blundell Road, South Elmsall, having consumed at least 10 cans of cider. His nephew and his nephew's girlfriend had also been visiting.

Just after midnight, the atmosphere turned sour when Hutton began accusing his partner of cheating on him.

The 35-year-old grabbed her by the throat and punched her in the head, before his nephew pulled him away.

Three neighbours, who had become increasingly worried by the domestic violence taking place in the property prior to that night, pushed their way into the house after hearing the screams and banging and managed to get the victim outside.

Hutton then followed them and tried to persuade them not to call the police and blaming his partner for the trouble.

Despite his arrest, his partner remained adamant that she did not want to press charges, admitting to police that Hutton had threatened to burn her family if she did.

The court was told that she suffered from learning difficulties.

During interview he denied being abusive but admitted arguing.

Mitigating for Hutton, Stephen Swan said that his client was a product of his environment, having suffered physical abuse as a child and spent his teenage years in care.

He had multiple convictions for violence, including battery.

Judge Neil Clark said: "The assault was part and parcel of the coercive and controlling behaviour.

"Your history of violence may have had an impact on the way you behave.

"The nature of the violence was such that an immediate sentence is one that can only meet the justice in this case."

Hutton, who has already been held on remand for 11 weeks at HMP Hull, was jailed for two years.
