Drunk assaulted man and racially abused police after being caught urinating in doorway of Leeds bar

A drunk assaulted a man in Leeds city centre after he was challenged for urinating in a doorway.

Neville Kirwan then racially abused two police officers who were called to deal with the incident.

The 52-year-old carried out the offences on December 13 last year at around 11pm.

Leeds Crown Court heard the victim challenged Kirwan as he walked past Cosmopolitan hotel and bar, on Swinegate, and saw him urinating in the doorway.

Dave Mackay, prosecuting, said Kirwan replied: "What the f*** has it got to do with you?"

He told Kirwan he should not be urinating in the doorway and walked away.

The defendant followed the man and said: "I will f***ing kill you."

The victim pushed Kirwan against a wall and a doorman came over and led him away before police arrived.

Mr Mackay said: "The next thing he (the victim) knew was he was bleeding heavily from a one-and-a-half inch cut to his check."

As he was being arrested, Kirwan swore and shouted racial abuse at the two officers

In his police interview, Kirwan apologised and said he would not have made the comments if he had been sober.

The victim was left with a scar on his cheek.

Kirwan, of Westbourne Avenue, Beeston, was found guilty of assault occasioning actual bodily harm after a trial.

He pleaded guilty to two count of racially aggravated harassment

Kirwan was the subject of a suspended prison sentence at the time for battery, criminal damage and harassment.

He has previous convictions for robbery and supplying cannabis

Probation officer Kerrie Wilson told the court she had to end an interview to discuss the offending with Kirwan as he verbally abused her.

She said: "Abuse seems second nature to him, whether he is in drink or not."

Mark Foley, mitigating, said Kirwan has long fingernails which may have been responsible for causing the injury to the victim.

He said the defendant is well-known for his 'irrational and erratic behaviour' in the Chapeltown community.

Mr Foley said his client has an alcohol problem, has borderline learning difficulties and cannot read or write.

The lawyer said Kirwan was 'lost' after his relationship with his partner ended.

Kirwan was jailed for 10 months.
