A driver told police he had drank half a litre of whiskey when he was stopped in his car on Christmas Eve

David Baldwin was stopped by officers when they became concerned about the way he was driving his car in Kippax on December 24 last year.

Leeds Crown Court heard Baldwin was seen to reverse his Hyundai Tuscan off a driveway at speed on Cross Hills Court.

Officers stopped the vehicle on Station Road and spoke to Baldwin.

Louise Gallagher, prosecuting, said the defendant's speech was slurred and he had a glazed look in his eyes.

Baldwin told the officers: "I'm p***** and I've got no licence."

The 31-year-old also said he had just drank half a litre of Jack Daniel's whiskey.

He was searched and was found in possession of a small bag of cannabis.

Baldwin was arrested but refused to provide a specimen of breath.

Baldwin was interviewed about the incident and, when asked why he had refused to provide the breath specimen, replied that he was "just being awkward."

At the time of the incident Baldwin was prohibited from driving after he had returned his licence to the DVLA for health reasons.

Baldwin, of Ramshead Approach, Seacroft, Leeds, pleaded guilty to failing to provide a breath specimen, having no insurance and possessing cannabis.

At the time of the offending he was the subject of a suspended sentence order for assault.

Baldwin was made the subject of a 12-month community order.

He was ordered to complete a 24-day rehabilitation activity requirement days and was banned from driving for three years.

Judge Penelope Belcher said: "You knew that not only were you under the influence of alcohol, you were not allowed to drive.

"You put yourself and all other road users at risk."
