Leeds man poured Pot Noodle over partner in violent rage

Adam Smith also slapped, punched the victim repeatedly to the head and body during the assault at his home in Kirkstall, Leeds.

Leeds Crown Court heard Smith, 21, attacked the 17-year-old victim in a jealous rage after grabbing her mobile phone from her.

The court heard the couple have a child together and were in a relationship at the time of the incident in November, 2014.

Patricia Westmorland, prosecuting, told the court Smith locked the front door and refused to let her leave the property after punching and slapping her.

He then phoned for a takeaway and attacked her again as they ate it.

Ms Moreland described how Smith picked up a fork and stabbed the victim in the feet with it before throwing a Pot Noodle over her.

He then ripped up a passport which he believed belonged to her but in fact belonged to the victim’s sister

She was eventually allowed to leave and told her mother about the attack. She suffered bruising to her stomach, feet and arms.

Smith was arrested and released on bail but attack the victim again three months later, on Valentine’s Day last year.

She needed hospital treatment after Smith caused injuries to her left hand when he threw punches at her.

Magistrates jailed Smith for 16 weeks over the second attack but failed to deal with the original offence.

Smith pleaded guilty to assault occasioning actual bodily harm and criminal damage over the November 2014 incident.

The Recorder of Leeds, Judge Peter Collier, QC, said his “hands were tied” over the punishment he could impose over the way the case had been dealt with by magistrates.

He told the court there was a “long standing principle” that he could not impose another custodial sentence if a defendant has served a jail term since the original offence.

smith was given a ten month sentence, suspended for two years, and ordered to do 120 hours unpaid work.

The judge told Smith: “It is my guess that you were prepared to go to prison today expecting to receive a further custodial sentence. That is what you deserve for the way you treated your former girlfriend.”
