Leeds man breached restraining order by going to live with ex-girlfriend when she was diagnosed with cancer

A man who breached a restraining order by going to live with his former partner after she was diagnosed with cancer has been sent to jail.

Daniel Shaw was locked up after police found him at the woman's home in Leeds despite a court order banning him from contacting her.

Leeds Crown Court heard there had previously been domestic violence in the relationship.

The 40-year-old was made the subject of a restraining order in October 2016 when he was convicted of harassment and sending a communication of an offensive nature.

He served an eight-week prison sentence in the same year for breaching the order.

Nick Adlington, prosecuting, said Shaw breached the order again by living with the woman and phoning her between September and November last year.

Police went to the woman's house on November 26 and stopped her as she was driving away.

She told officers that Shaw was inside her house but that she did not want anything to do with his arrest.

The defendant began calling her as she spoke to officers and his name appeared on her phone's screen.

Police found Shaw inside the house and arrested him.

He was interviewed and admitted that the couple had lived together for about three months.

Shaw claimed he did not have enough money to get the restraining order revoked.

Shaw, of Hall Lane, Chapeltown, Leeds, told officers that the woman had asked him to leave the house during an argument but said they were still in a relationship.

He pleaded guilty to two counts of breaching a restraining order.

Shaw has seven previous convictions for nine offences.

Stephen Welford, mitigating, said his client was diagnosed with HIV in 2016 which caused problems in the relationship.

Mr Welford said his ex-girlfriend contacted him after being diagnosed with breast cancer and he went back to live with her to help her.

He added that said Shaw no longer had any contact with the woman and had a new partner.

Judge Mushtaq Khokar described Shaw's breaches of the restraining order as "persistent and repeated".
