Pontefract driver death crash payout

A devastated mum whose seven year-old-son and husband were killed by a Pontefract driver has been awarded £425,000 compensation by a top judge.

Alan Oliver, of Fairfield Avenue, Pontefract was jailed for nine years after admitting causing the deaths of father-of-five Steve Pethig, 27, and Billy Pethig, seven by dangerous driving in December 2005.

Widow Kerry Pethig went to court seeking compensation from Oliver, who was uninsured at the time of the horror smash at an accident black spot on Malmaynes Hall Road, Stoke, near Rochester, Kent.

And yesterday the Motor Insurers' Bureau (MIB), an industry body that steps in to cover the liabilities of uninsured drivers, agreed to settle the case for 425,000.

Mr Pethig and his son, were parked by the side of the road when Oliver's car veered across the carriageway and slammed into them.

The father and son – from the Isle of Grain, near Rochester – were struck by his Rover after a breakdown on the A228.

Mr Pethig died at the scene and his son died later in hospital.

The 31-year-old widow, who lives near Grain, was left to raise her four other children, aged between ten and five.

The mum was in the High Court yesterday as the final details of the

settlement were approved by Mr Justice Burnett.

Describing the payout as "entirely appropriate" the judge said: "I hope that the conclusion of the proceedings will help Mrs Pethig come to terms with what has happened, and that the settlement will make life a little easier for her in the future.

"I wish her and her children all the best."

Under the terms of settlement the surviving children will receive a

part of the 425,000 lump sum in memory of their father.
